Terms of Service

These Terms of Service (“Terms”) govern your use of tcalroofing.com (the “Site”), operated by TCAL Roofing and Restoration Inc.(“TCAL Roofing,” “we,” or “us”). By using the Site or submitting a form, you agree to these Terms. If you do not agree, please do not use the Site.

About our services

TCAL Roofing offers roof inspections, repairs, replacements, and assistance documenting damage in connection with property insurance claims. We are a licensed California roofing contractor. We are not a licensed public adjuster, an attorney, or a representative of any insurance carrier. Nothing on the Site is legal, tax, or insurance advice.

Free inspections

When we offer a free roof inspection, the inspection itself is free of charge with no obligation to use our services. The inspection is for evaluating roof condition and identifying damage. It is not a guarantee that any insurance carrier will accept, approve, or pay any particular amount on a claim. Insurance outcomes depend on your policy, the carrier, the facts of the claim, and other factors outside our control.

Communications

When you submit a form, you consent to be contacted by phone, text, or email about your inspection and any related work, as described in our Privacy Policy. You can withdraw text consent at any time by replying STOP.

Information you provide

You agree that the information you submit through the Site is accurate to the best of your knowledge, that you have authority to provide it (for example, that you own the property or are authorized to seek services for it), and that we may rely on it when scheduling and providing services.

Site content and intellectual property

The Site, including text, graphics, logos, photos, and the TCAL Roofing name and marks, is owned by us or our licensors and is protected by copyright, trademark, and other laws. You may view, save, and print pages for personal, non-commercial use. You may not copy, modify, distribute, scrape, or use the Site or its content for commercial purposes without our written permission.

Third-party links

The Site may link to third-party websites or services. We do not control those sites and are not responsible for their content, policies, or practices. Following a third-party link is at your own risk.

Disclaimers

The Site and any free inspection are provided “as is” and “as available.” To the fullest extent permitted by law, TCAL Roofing disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. Case study outcomes shown on the Site are representative examples; individual results vary based on policy, damage, carrier, and other factors. We do not promise any specific claim outcome, payout, timeline, or coverage.

Limitation of liability

To the fullest extent permitted by law, TCAL Roofing and our owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including lost profits, lost data, or claim outcomes. Our total liability for any claim relating to your use of the Site will not exceed one hundred dollars ($100). This limitation does not apply to liability that cannot be limited by law.

These Terms cover your use of the Site. Separate written agreements govern any roofing work we perform for you, including warranty terms.

Indemnification

You agree to defend, indemnify, and hold TCAL Roofing harmless from any claims, damages, losses, and reasonable costs (including attorneys’ fees) arising from information you submitted that turns out to be inaccurate, your violation of these Terms, or your misuse of the Site.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising from the Site will be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts. Nothing in these Terms prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and revise the effective date above. Your continued use of the Site after changes are posted means you accept them.
